This is the Privacy Policy of Wesbild Holdings Ltd. and its affiliated companies, partnerships and entities (collectively, “Wesbild”, “we”, “us” and “our”). It describes how we collect, use, disclose and protect personal information of individuals who interact with us — including prospective and existing purchasers, residents, commercial tenants, realtors, warranty claimants, visitors to our properties, visitors to our website, and job applicants.

This Privacy Policy is designed to comply with British Columbia’s Personal Information Protection Act (“PIPA”) and, to the extent applicable, the federal Personal Information Protection and Electronic Documents Act (“PIPEDA”) and Canada’s Anti-Spam Legislation (“CASL”). Wesbild is a subsidiary of Persis Holdings Ltd. and may share information within that corporate group as described below.

2. Information We Collect

We collect personal information only to the extent reasonably necessary for the purposes described in this Policy. The categories of information we may collect include:

Identification and contact information including name, mailing address, email address, and telephone numbers.
Registration and preference information including how you heard about us, communities of interest, preferred home type, prior residence status, first-time buyer status, investment intent, and preferred method of contact.
Transaction information, including financial and credit information required for deposits, purchase agreements, lease applications, and completion of transactions.
Realtor-sourced information where a licensed real estate professional registers you as a prospective purchaser on your behalf.
Customer care and warranty information including service request details, correspondence, and related records generated after you take possession of a home.
Commercial tenant information including lease application details, financial and insurance information, and contact information for authorized representatives.
Employment application information including resume, cover letter, references, and other information submitted in connection with a job or contractor application.
Online and device information including IP address, browser type, device identifiers, referring URLs, and information collected through cookies and analytics tools.
Video surveillance recordings captured at sales centres and certain commercial and industrial properties, for safety, security and loss-prevention purposes.

3. How We Use Personal Information

We use personal information for purposes including:

Responding to inquiries and requests for information.
Providing updates about current and future residential, commercial, industrial and mixed-use projects.
Administering registrations, presentation-centre visits, and events.
Preparing, completing, and administering purchase and sale agreements, leases, and related transactions.
Processing and responding to warranty and customer-service requests.
Evaluating employment and contractor applications.
Conducting market research, analytics and product development, generally in aggregated or de-identified form.
Protecting the safety and security of our personnel, visitors and premises, including through video surveillance.
Meeting legal, regulatory and contractual obligations.

4. Consent

We collect, use and disclose your personal information with your consent, except where permitted or required by law to do so without consent.

Express consent is obtained where required by law, including for marketing electronic messages under CASL.
Implied consent may be relied on where appropriate (for example, when you voluntarily provide information in connection with an inquiry, registration, transaction or warranty request).
Deemed consent may apply in circumstances recognized under PIPA (for example, where consent would be unreasonable to obtain and the collection is clearly in the individual’s interests).

You may withdraw your consent at any time, subject to legal and contractual restrictions and reasonable notice, by contacting our Privacy Officer. If you withdraw consent, we may no longer be able to provide you with certain services or communications, and we will advise you of the likely consequences before giving effect to your withdrawal.

5. Sharing of Personal Information

We do not sell or rent your personal information. We may share your personal information in the following limited circumstances:

Within our corporate group. We may share information among the Wesbild group of companies and with our parent company, Persis Holdings Ltd., for the purposes described in this Policy, including consistent customer service and integrated administration.
Service providers. We may share information with service providers that perform functions on our behalf, including information-technology and hosting providers, customer-relationship management platforms, email and communication service providers, analytics providers, marketing agencies, accountants, lawyers, warranty administrators, and construction trades assisting with warranty service. We require service providers to use personal information only for the purposes for which it is disclosed and to maintain appropriate safeguards.
Business transactions. We may share information in connection with a proposed or completed sale, merger, acquisition, financing, reorganization or similar transaction involving all or part of our business, subject to confidentiality safeguards. Any successor will be bound by this Privacy Policy or an equivalent policy.
Legal requirements. We may share information where required or permitted by law, including in response to a court order, regulatory investigation, or other legally valid request from government or law enforcement authorities.

6. Cross-Border Storage and Processing

Some of our service providers are located outside Canada. Your personal information may therefore be transferred to, stored in, or processed in jurisdictions outside Canada. In those jurisdictions, personal information may be subject to local laws that allow access by courts, law enforcement, and national-security authorities. We take reasonable steps to ensure that service providers outside Canada protect your personal information to a standard consistent with this Policy and with applicable Canadian law.

7. Cookies, Analytics and Online Tracking

When you visit our website, we and our service providers may collect information automatically using cookies, pixels, web beacons and similar technologies. We use these technologies to operate the website, understand how visitors interact with it, improve user experience, and, where you have consented, deliver tailored advertising. You can also adjust cookie and tracking preferences through your browser settings. Disabling cookies may affect the functionality of parts of our website.

8. Marketing Communications

We send marketing communications only where permitted by law. Where CASL applies, we will obtain express or implied consent as required, and every commercial electronic message we send will identify Wesbild, include our contact information, and include a functioning unsubscribe mechanism.

You may withdraw consent to marketing communications at any time by using the unsubscribe link in any email, replying “STOP” to any text message, or contacting our Privacy Officer. Withdrawing marketing consent will not affect transactional communications relating to an active purchase, lease, warranty claim, or service request.

9. Retention

We retain personal information only as long as reasonably necessary to fulfill the purposes for which it was collected or as required or permitted by law, including obligations under the Real Estate Development Marketing Act, the Homeowner Protection Act and its regulations, applicable tax legislation, and employment-standards legislation. When personal information is no longer required for these purposes, we will securely destroy, erase, or anonymize it.

10. Safeguards

We maintain administrative, physical and technical safeguards appropriate to the sensitivity of the personal information in our custody. These include restricted access to information on a need-to-know basis, secure storage of physical records, and reasonable security measures for our information systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security, but we take reasonable steps to protect your information against unauthorized access, use, disclosure, loss or modification.

11. Breach Notification

If a breach of security safeguards involving your personal information occurs and the breach poses a real risk of significant harm, we will notify affected individuals and the applicable regulators in accordance with the requirements of applicable privacy laws. We will also maintain records of any such breaches as required by law.

12. Access, Correction and Complaints

You have the right to request access to, and correction of, the personal information we hold about you, subject to limited exceptions permitted or required by law. Please submit requests in writing to our Privacy Officer at the contact information in Section 1, with sufficient detail to enable us to identify the information at issue. We may need to verify your identity before responding to a request. We will respond to an access request within 30 days, or we will notify you within 30 days that we are extending the response time by up to a further 30 days (or, where permitted, for a longer period with the approval of the BC Information and Privacy Commissioner). If you have a concern or complaint about our handling of your personal information, please contact our Privacy Officer. If you are not satisfied with our response, you may contact the Office of the Information and Privacy Commissioner for British Columbia.

13. Employment Applications

We use the personal information you submit in connection with a job or contractor application to evaluate your candidacy. With your consent, we may conduct reference or background checks where appropriate. We retain unsuccessful applications for a reasonable period to consider you for future opportunities, unless you ask us to delete your information sooner.

Our website may contain links to third-party websites. We are not responsible for the privacy practices of those websites and encourage you to review their privacy policies before providing them with personal information.

15. Changes to This Policy

We may update this Privacy Policy from time to time. Where a change is material, we will notify you by prominent notice on our website and, where appropriate, by email. We will not apply material changes retroactively in a way that reduces the protection of personal information we have previously collected about you without first obtaining any further consent required by law. The Effective Date at the top of this Policy will be updated whenever the Policy is revised.
